Terms of Service

Effective date: August 30, 2025

These Terms of Service (“Terms”) govern your use of playhole.io (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Who We Are

Playhole.io operates a browser‑games platform featuring games we develop, games we license from partners (e.g., GameMonetize and GameDistribution), and games submitted by independent developers.

2) Changes to the Terms

We may update these Terms at any time. The “Effective date” will change when updates are posted. Continued use after changes means you accept the updated Terms.

3) Eligibility

The Site is for users who can legally form a binding contract or who have a parent/guardian’s consent. The Site is not intended for children under 13 (or the age defined by local law).

4) License to Use the Site

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Site for personal, non‑commercial entertainment. Except as explicitly allowed by law, you may not copy, modify, host, stream, distribute, scrape, reverse engineer, or create derivative works from the Site or its content.

5) Third‑Party Content & Links

Many games and certain features are provided via third‑party iframes, SDKs, or links. Those services are governed by their own terms and privacy policies. We are not responsible for third‑party content, availability, or practices.

6) Accounts

We currently do not require accounts to play on the Site. Some third‑party games may ask you to create an account with that third party; your use of those accounts is between you and the third party.

7) Acceptable Use

You agree not to:

  • Violate any law or infringe others’ rights (including IP rights).
  • Upload, submit, or link to unlawful, harmful, misleading, or inappropriate content.
  • Attempt to gain unauthorized access to the Site or disrupt its operation.
  • Use bots, scrapers, or automated means without written permission.
  • Cheating or exploitation that negatively impacts other users or our partners.

8) Intellectual Property

Except for third‑party materials and games licensed to us, the Site and all original content are owned by Playhole.io and protected by applicable IP laws. All trademarks, logos, and names are the property of their respective owners.

9) Developer Submissions

If you submit a game or other content (“Submission”):

  • You represent and warrant you have all necessary rights to submit and license the content and that it does not infringe others’ rights.
  • License to us: You grant Playhole.io a worldwide, non‑exclusive, sublicensable, transferable license to host, reproduce, display, distribute, promote, and otherwise use your Submission on the Site and our channels to operate and market the platform. Any specific monetization or revenue‑share terms must be agreed in writing.
  • Removal: We may reject or remove Submissions at our discretion (e.g., for quality, legal, or policy reasons). We will endeavor to notify you at the email you provide.
  • Indemnity: You agree to defend, indemnify, and hold Playhole.io harmless from claims arising out of your Submissions, including IP or privacy claims.

10) Takedowns (DMCA)

We respect intellectual property rights and respond to notices consistent with the DMCA and similar laws. See our DMCA page for instructions.

11) Disclaimers

THE SITE AND ALL GAMES/CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT CONTINUOUS, ERROR‑FREE, OR SECURE ACCESS, OR THAT DEFECTS WILL BE CORRECTED.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYHOLE.IO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

13) Indemnification

You agree to indemnify and hold harmless Playhole.io from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your Submissions, or your violation of these Terms or applicable law.

14) Governing Law & Disputes

These Terms are governed by the laws of the Kingdom of Morocco, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the courts located in Casablanca, Morocco, for any dispute arising from or relating to these Terms or the Site, except where another jurisdiction’s consumer protection laws provide otherwise and cannot be waived.

15) Termination

We may suspend or terminate your access at any time, with or without notice, for any reason. Upon termination, sections intended to survive (e.g., IP, disclaimers, limitations, indemnity, governing law) shall continue in force.

16) Miscellaneous

If any provision is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Site.
